HHC INFORMATION NOTE ON THE TREATMENT OF DUBLIN RETURNEES IN HUNGARY, DECEMBER 2011

Asylum seekers returned in the Dublin procedure to Hungary may be at risk of refoulement – they could be removed from the country before their asylum claim is examined on the merits. They are also routinely placed in immigration detention, without the possibility of an effective judicial review of their detention. The Hungarian Helsinki Committee urges EU Member States and national courts to carry out a thorough and individualised assessment of the conditions the asylum-seeker would face upon return to Hungary when deciding about Dublin transfers.
